CANCELLATIONS & REFUNDS

Cancellation & Refund Policy

How cancellations, earned professional fees, and unused advance payments are handled.

Effective November 7, 2026

FortLyn is a trade name of EnvyInk, Inc. This policy describes cancellations and refunds for FortLyn professional services. Refunds are determined under the signed agreement, approved scope and applicable law. Payment in advance does not make unperformed services automatically nonrefundable.

1. Your signed terms control

The signed Master Services Agreement, statement of work, service schedule, license order and any signed amendment govern the engagement. Specific written terms agreed for your project control over this general policy where they differ, subject to applicable law. An estimate is not a final scope or authorization to begin work. Later website updates do not retroactively change an existing agreement.

2. Consulting time and work already performed

Authorized professional time is billable as it is performed, including discovery, environment reviews, consultation, analysis, research, planning, configuration, testing, project-specific meetings, documentation and handoff. This applies even if you later decide not to implement the recommendations. Charges must relate to the approved engagement and use the rate, fee or milestone allocation agreed before work begins. General sales discussions are not automatically billable. The same work will not be charged twice.

3. How a partial refund is calculated

The refundable service balance is the amount paid, less earned fees for authorized work actually performed and approved, unavoidable third-party costs, with applicable credits and tax adjustments. For hourly engagements, earned fees use recorded time at the agreed rate. For fixed-fee projects, completed and partially completed work is valued proportionately against the agreed deliverables or milestone allocations, supported by work records. A fixed fee is not automatically converted to hourly billing, and a partially completed milestone is not automatically charged in full. Unperformed future labor is not earned merely because it was prepaid.

4. Assessment fees and changes in scope

A separately agreed consulting or assessment fee covers the authorized review and is earned as that review is performed. Its amount, scope and any credit toward implementation must be stated in the agreement or approved proposal. If review identifies work outside the agreed scope or price, FortLyn will explain the proposed additional work, fee and schedule before proceeding. You may approve the change and required payment, retain the original scope where viable, or cancel under the applicable terms. Cancellation does not erase fees earned for a completed review. A different refund expressly promised for a specific engagement will be honored.

5. Requesting cancellation or pausing work

Send written notice to charles@fortlyn.com identifying your company, agreement or invoice number, the services affected and your requested end date. Unless your signed agreement provides otherwise, an uncompleted project may be ended for convenience on five business days' written notice. FortLyn will confirm receipt, the effective date and any steps needed for an orderly stop. A phone call, unused account, removal of access or payment dispute does not by itself cancel a service or subscription. Work during a notice or wind-down period must remain authorized, necessary and documented; notice is not permission to incur avoidable additional charges. Any legal right to use another notice method remains intact.

6. Recurring services and vendor commitments

Recurring support follows the term and notice requirements in your signed service schedule. The standard month-to-month schedule provides thirty calendar days' written notice and charges for actual coverage through the effective end date; prepaid service periods after that date are credited or refunded proportionately. Separately approved software subscriptions, licenses, domains, hosting, hardware, travel or vendor purchases may have different cancellation windows or noncancelable commitments. Monthly billing does not necessarily mean a monthly commitment. Ending FortLyn services does not automatically cancel those obligations. We will identify approved unavoidable costs, seek available credits and pass through recoveries attributable to your purchases. This does not excuse FortLyn ordering errors or unauthorized purchases.

7. Reconciliation and refund processing

FortLyn will provide an itemized reconciliation showing payments, work performed, earned fees, approved unavoidable costs, credits and the resulting balance. Unearned, undisputed advance payments will be refunded within fifteen business days after the reconciliation is agreed, or sooner where required by applicable law or the signed agreement. A dispute over one amount will not be used to withhold a separate undisputed refund. Refunds generally return through the original payment method, subject to the processor's rules; bank posting and ACH settlement can take additional time. Duplicate or mistaken payments will be reviewed and corrected. Processor charges are not automatically deducted from your refund: any deduction must have been disclosed and agreed in advance and be lawful.

8. Service concerns and safe handoff

If you believe delivered work does not meet the signed scope, notify us with the affected deliverable and the issue so it can be reviewed under the agreement's correction and remedy provisions. The standard agreement provides a thirty-day correction period for reproducible implementation defects; it does not waive other applicable rights. Cancellation does not authorize deletion of your data or withholding your owner accounts or administrator access as leverage. Agreed deliverables and handoff responsibilities remain subject to the signed terms. Additional transition services require approval.

9. Billing questions and payment disputes

Contact charles@fortlyn.com promptly with any billing concern and the relevant invoice or payment reference. FortLyn will review supporting records and explain the calculation in good faith. Asking you to contact us does not restrict lawful bank, card-network, regulatory or court remedies or shorten a legal claim period. We will coordinate any refund and existing bank dispute to avoid duplicate reimbursement. Any remaining amount owed must be supported by the agreement and the work or commitment actually authorized.

10. Texas law and policy updates

Where provided in the signed agreement and permitted by law, Texas law governs the engagement. Applicable federal law and nonwaivable protections in other jurisdictions remain in effect. Nothing in this policy eliminates mandatory cancellation or refund rights, excuses fraud or deceptive practices, or creates a blanket waiver of consumer protections. Governing-law and court provisions remain those of the signed agreement; this page does not impose a new county, arbitration requirement or shortened deadline. Updated versions apply prospectively as permitted by the agreement and law. Questions and cancellation notices may be emailed to charles@fortlyn.com. Do not send card numbers, security codes, passwords or identity documents with a request.
